Nashfolk is a customized service provided by Nashfolk AS ("Nashfolk") and can be downloaded as mobile phone applications or used on the website nashfolk.no. Nashfolk is to provide a tool for home buyers to communicate so they can find their ranking among other users according to their available equity and access for borrowing when they approach buying residential units. The purpose of Nashfolk is to aid the user in the home bidding process. You can find more information about Nashfolk and how it can be used at www.Nashfolk.no.
This Agreement consists of the terms and conditions in this document and the Nashfolk Privacy Protection Policy (jointly referred to as "the Agreement"). In addition to the terms and conditions in the Agreement, relevant prevailing Norwegian statutory provisions also apply. The parties to this Agreement are you, as a customer, and Nashfolk AS, Rødtvetveien 69 Oslo, org.no. 824 489 912.
All the terms below must be fulfilled in order to use Nashfolk: You must have a Norwegian phone number. You must have a bank letter that has been issued by one of the Norwegian banks as requested to approach buying residential unit. Nashfolk can be used on website, mobile phones with iOS and Android operating systems. You must have an e-mail address. You must be over the age of 18 in order to create a user profile. You must have read, understood and accepted this Agreement. Nashfolk has the right approve or reject you as a user.
Nashfolk is a solution that enables you to find your ranking between other users who are interested in buying
the same residential units that are offered for sale and available for bidding. You can choose up to 5 different
listings. You can remove listings. Nashfolk technology and artificial intelligence resources are designed to
measure your ranking among other users and notify you, and them, with the ranking. This information is intended
to give you an insight to visualise a strategy when approach bidding process for the listings that you have
chosen, as an advice.
By accepting the terms and condition, you acknowledge and confirm that you understand that Nashfolk is providing
you with advice without any obligation or guarantee that your ranking given by Nashfolk will correspond with
your results in the following bidding round and that Nashfolk cannot be held responsible for any subsequent
events leading to a result that may differ from Nashfolk predictions.
Before you start using Nashfolk, you must create a user profile and identify yourself. When registering for the first time, you will have to identify yourself by completing the registration procedure in Nashfolk. Nashfolk, eventually, will verify your identity, for example by automatically checking it against any Norwegian register system and verify the phone number users using the Firebase Authentication phone number sign-in service. You consent and agree to using Firebase Authentication phone number in the sign-in/log in/registration with Nashfolk service.
After signing up or logging in, you will be requested to insert the equity amount that you can use and the loan
amount that you can get from your bank, together, will be summed up to calculate the (Total amount available for
bidding). This number is the key information that will be processed by Nashfolk. Nashfolk will match this number
with the information provided and included in the (Bank letter), the (Bank Letter) is requested to be uploaded
by you. Nashfolk will compare this number (Total amount available for bidding) with the other users who are
interested in the same listing. This functionality is to provide you with Nashfolk services, without sharing any
personal information.
Nashfolk has set 3 months as a maximum period for using the bank letter in Nashfolk platforms. You should upload
new bank letter after that.
It is easy to sign up or log in with your Nashfolk profile with fingerprint in Android version, fingerprint or
Face ID on the iOS devices, or by username or password that use the functionality ‘Nashfolk Log in’.
Nashfolk Log in means that you don’t have to enter the information that is often required, such as name, email
address or phone number. Nashfolk Log in also means that you don’t have to worry about usernames and passwords.
Nashfolk Log in enables you to be remembered in the browsers you use, e.g. Internet Explorer, Edge, Google
Chrome, Safari or Firefox for easiest possible login.
In order to prevent others from gaining access to data about you, it is important that you securely store and keep the devices where you have used Nashfolk Log in. You should also ensure such devices have a screen lock or similar. You should not let other people use or have access to such devices. We recommend that you do not use Nashfolk Log in on shared PCs or mobile devices that other people have access to.
If devices where your Nashfolk Log in are installed are lost or stolen, we recommend that you immediately email Nashfolk on info@nashfolk.no from your registered email address, so we can prevent your account to be used against your willing. We recommend you register again with new password should you wish use Nashfolk services.
3.4.2 Information security and recognition technology in connection with Nashfolk Log inWe use cookies to provide Nashfolk Log in. Nashfolk Log in also use a security solution that retrieves information about your browser to confirm that the cookies have not been copied or changed. Nashfolk Log in will not give anyone access to this information and the cookies will not be transferred to any third parties. You are deemed to have accepted the use of cookies as long as this functionality is turned on in your browser. If you turn off cookies, the Nashfolk Log in service will not work. To be able to recognise your devices, we use a cookie with a unique numerical value. The numerical value has been randomly generated, and others cannot deduce your identity from it. We are the only party to have this link to your identity, and this information is protected by the highest data security and access requirements. Nashfolk Log in will analyse information about your browser to increase security. Such information includes different properties that can be retrieved using standard technology (known as device fingerprinting technology). Nashfolk can also register and store other data about your use of Nashfolk Log in to ensure your security and to counteract criminal activity. Such security data can include user behaviour and the condition of the device. This data can only be used to detect deviations from normal values to counteract and, if relevant, follow up criminal activity targeting you or other Nashfolk users.
In order to enjoy access to Nashfolk services, your account information in Nashfolk must be verified by Nashfolk service controller. and you will have to consent to access all of your information that has been uploaded and shown in Nashfolk.
You are responsible for ensuring that the information you provide about yourself to Nashfolk is complete, correct and updated. If there are any changes in your data, you are responsible for correcting the information in Nashfolk. You are responsible for providing your correct name, e-mail address, telephone number, the intended equity amount that will be used, the available loan amount, and bank letter.
If your mobile phone is stolen or lost, or if you suspect unauthorised use of Nashfolk, you must notify Nashfolk AS soon as possible on info@nashfolk.no. When such notification has been given, Nashfolk will block the use of Nashfolk until further notice.
You cannot use Nashfolk in breach of prevailing Norwegian law or in violation of this Agreement. If you are to use Nashfolk for business purposes you are not allowed to use Nashfolk services. You cannot use Nashfolk on a mobile phone which is jailbroken/rooted. The use of Nashfolk on a phone which is modified in this way creates a risk for the misuse of Nashfolk and compromises the information entered in the app. Nashfolk will therefore consider the use of Nashfolk on a device which is jailbroken/rooted as a serious breach of the terms and conditions for the use of Nashfolk.
If Nashfolk has reasonable grounds to believe that your use of Nashfolk is in violation of law or this Agreement, Nashfolk is entitled to temporarily stop your use of Nashfolk. If such use is not discontinued or represents a serious breach of the Agreement, Nashfolk is entitled to terminate the Agreement. Nashfolk is under no obligation to inform you before the Agreement is terminated but will seek to give such notice and to provide you with the opportunity to rectify the matter if this is possible. By accepting the terms and condition, you acknowledge and confirm that you understand that Nashfolk has the right to take actions and measures, including but not limited to, deleting your profile and prevent you from using Nashfolk service, if you have plugged/entered wrong, or used misleading information or forged bank letter, or you have used Nashfolk services for purposes other than the intended purposes of Nashfolk different platforms and services, including but not limited to, using Nashfolk different platforms and services to get inside information as a home seller or seller representatives or real estate agents. In those cases, Nashfolk has the right to claim compensation for any damage that may be caused to it or its users. Nashfolk will take all measures available and legal means to claim compensation for any damage caused to Nashfolk or its users.
By entering into this Agreement, you consent that the Agreement is entered into electronically and that this also applies to amendments to the Agreement. You accept that Nashfolk will communicate with you directly in Nashfolk, to the telephone number you have stated in Nashfolk, or by using your stated e-mail address.
In order to enable you to use Nashfolk, Nashfolk needs to receive, use and store some of your personal data. Most of these data are provided by yourself in Nashfolk when you register and are generated when you use the service. Nashfolk has a separate Privacy Policy, in the Nashfolk menu. Nashfolk Privacy Protection Policy is part of the Agreement.
The Agreement remains in force as long as Nashfolk offers its services. Nashfolk can choose to no longer provide Nashfolk subject to two months' notice. If you have breached the Agreement, Nashfolk can terminate the Agreement with you without prior notice. If you wish to terminate the Agreement, this can be done by contacting Nashfolk. Please note that the Agreement will remain in force even if you delete Nashfolk from your mobile device. If you do not use Nashfolk over a period of six months, Nashfolk can choose to deactivate your Nashfolk profile.
Nashfolk can make amendments to the Agreement without prior notice. The prevailing terms and conditions of the
Agreement will be available in Nashfolk and at www.Nashfolk.no. Amendments which are not in your favour may only
be implemented by Nashfolk subject to two months' notice. If you do not wish to accept amendments to the
Agreement, you must terminate the Agreement and your use of Nashfolk. If you continue to use Nashfolk after the
Agreement has been amended, the amendments are deemed to be approved by you. Amendments to the registration
procedures to comply with regulatory and security requirements, or to prevent unlawful activity, can be
implemented by Nashfolk without prior notice.
You can contact Nashfolk at any time and ask to receive these terms and conditions in a paper version.
Nashfolk's obligations under this Agreement shall temporarily cease to apply if circumstances arise which are beyond Nashfolk's control, which Nashfolk could not reasonably be expected to have foreseen or avoided the consequences of and which render impossible completion of the Agreement. The same applies to circumstances which are due to Nashfolk's statutory obligations or pursuant to law.
